LMIA Application

  5. Wages: Information about the TFW’s pay must be included in applications. This will guarantee that TFWs receive the same compensation for their labor as their Canadian counterparts and distinguish high-wage jobs from low-wage roles.
  6. Workplace Safety: TFWs are entitled to the same requirements for occupational health and safety as Canadians who hold equivalent positions. Because of this, employers are required to show proof that TFWs will have insurance that at least matches the health benefits provided by the province or territory in which the firm is located.

Approval of LMIA

Following the processing of an LMIA application, employers will receive a decision. The employer may proceed with recruiting a foreign national if they receive a positive LMIA. Unfortunately, the business is not permitted to hire a foreign national if a negative LMIA is granted.

 

The validity of positive LMIAs is 6 months from the date of issuance. The company has to let the foreign national know if their LMIA is positive so they can apply for a work visa or permanent residence. Employers may request to have their LMIA application handled in ten days under specific circumstances. An employer must be based outside of Quebec and fulfill one of the following criteria in order to be eligible for expedited processing:

 

  • Positions with the highest pay: the top 10% of Canadian salary in the province or territory where the employment is located.
  • Paid at least the median provincial/territorial wage for the employment in skilled trades.
  • Jobs with a short duration: 120 days or less
  • Express Entry: An applicant for Express Entry is to be assisted by the LMIA.
